General Terms and Conditions
These terms govern the ordering and delivery of our individually created, digitally provided photo shoots.
1. Provider and Scope
These General Terms and Conditions apply to contracts between Hetrex Media S.R.L., trading as SCENYOU, Strada Closca, BL34 AP14, 555200 Avrig, Sibiu, Romania, Commercial Register J32/1648/2021, Tax Number 44797988, e-mail hello@scenyou.com, and its customers.
Deviating terms apply only if we have expressly agreed to them in text form. Individual agreements take precedence.
2. Subject Matter of the Service
Based on the photos, selections and briefing you provide, SCENYOU creates individually designed digital portraits and image series. No physical photo shoot takes place at the depicted locations. AI systems support image editing, retouching, scene design and quality control; creative selection and approval are carried out by humans.
The specific scope results from the service description shown at the time of order: in particular the number of final images, looks, correction rounds, file formats, additional services, price and expected processing time. Look examples describe a creative direction but do not guarantee an identical pose, environment or effect. We aim for the most realistic, character-faithful and carefully optimized portrayal possible; however, an exact 1:1 match with the person or their individual expression cannot be guaranteed, and variations may occur.
3. Customer Account and Conclusion of Contract
A personal account is required to place an order. Your order constitutes a binding offer. The contract is concluded when we expressly confirm the order by e-mail or begin performing the service. An automated acknowledgment of receipt alone does not constitute acceptance unless it is expressly designated as an order confirmation.
Before submitting your order, you can review and correct all information. The contract text, package scope and price are assigned to your order and made available in your customer account. The contract language is German.
4. Cooperation and Rights to Uploads
You provide suitable, current and sufficiently sharp source photos and answer any necessary follow-up questions. You warrant that you are entitled to use the uploaded files and to make them available to us for performance of the contract, and that the rights of depicted persons or third parties are not infringed.
Delays caused by missing, unsuitable or late information will reasonably extend the processing time. We may refuse orders that are unlawful, deceptive, discriminatory or that infringe the rights of third parties.
5. Prices and Payment
The total price shown in Euro at the order step applies. Hetrex Media S.R.L. currently does not charge value added tax. Additional services are only charged if they were selected or subsequently expressly commissioned. Available payment methods and the due date are shown during the ordering process.
Production generally begins after confirmed receipt of payment or express manual approval. In the event of default of payment, the statutory rights apply. Counterclaims may only be set off if they are undisputed or have been finally and non-appealably established; statutory consumer rights remain unaffected.
6. Processing, Delivery and Corrections
Processing times are estimates and only begin once payment, suitable images and complete information are available. Finished files are made available in the protected customer account. For digital content, risk and access pass upon provision.
Included correction rounds relate to adjustments to an existing image version. New looks, scenes or fundamental changes to the briefing may constitute chargeable additional services and will be confirmed in advance.
7. Usage Rights
Upon full payment, you receive a simple, temporally and territorially unrestricted right to use the finally delivered images for private purposes and for the professional self-promotion purposes stated in the order. Transfer to third parties, resale, sublicensing, use as training material for models, or use in unlawful or misleading contexts requires our prior consent.
Use by SCENYOU for portfolio, advertising or social media purposes takes place only after separate, voluntary consent. This consent may be withdrawn with effect for the future.
8. Rights in the Event of Defects
The statutory warranty rights for digital products and services apply. Please describe any recognizable technical or content-related deviations as specifically as possible. Failure to report a defect immediately does not cause statutory consumer rights to lapse.
An exact 1:1 match in appearance, expression or individual character is not guaranteed. Variations inherent in digital image creation may occur despite careful editing and human quality control. Statutory rights in the event of defects remain unaffected, particularly where the agreed characteristics or objectively required quality are not met. No particular effect or application outcome is guaranteed either.
9. Liability
We are liable without limitation for intent, gross negligence, injury to life, body or health, and under mandatory product liability law. In the case of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
10. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal. Details, the conditions under which this right lapses in the event of early commencement of performance, and the model withdrawal form can be found in the Withdrawal Instructions. If required, consent to early commencement will be obtained separately during the ordering process.
11. Term, Suspension and Termination of the Account
The customer account runs for an indefinite period and deletion may be requested at any time. Order, payment and invoice data that must be retained by law remain stored until expiry of the respective statutory period. We may suspend accounts in the event of abusive use or significant breaches of contract after weighing the respective interests.
12. Dispute Resolution, Law and Jurisdiction
The former EU platform for online dispute resolution was discontinued on 20 July 2025. We are currently neither obliged nor willing to participate in proceedings before a consumer arbitration board, unless a mandatory statutory obligation exists.
Romanian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of their habitual residence. For merchants, to the extent permitted, the registered office of the provider is the place of jurisdiction.
13. Final Provisions
Should individual provisions be invalid, the remainder of the contract remains valid. Statutory provisions replace any invalid provisions. Amendments to these terms do not apply retroactively to orders already concluded.
